1. Parties
This Distance Sales Agreement; has been entered into electronically between, on the one hand, the SELLER whose information is provided above and, on the other hand, the BUYER who is a member of or has purchased a product from the www.devasafran.com e-commerce site, in accordance with the provisions of the Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts.
2. Subject
The subject matter of this agreement is to define the rights and obligations of the parties regarding the sale and delivery of the product ordered by the BUYER electronically via www.devasafran.com, the characteristics and sales price of which are specified in the order summary.
3. Product Subject to the Agreement and Payment
The product type, quantity, brand/model, sales price, payment method, and delivery information are as specified in the order confirmation and invoice. Payment is made via one of the following methods: credit/debit card (3D Secure), bank transfer/EFT, or cash on delivery. The product price includes VAT.
4. General Provisions
The BUYER acknowledges that they have read and are aware of the preliminary information regarding the essential characteristics of the product subject to the contract, the sales price, the payment method, and delivery, and that they have provided the necessary confirmation electronically. The product will be delivered to the address specified by the BUYER via a shipping company. The delivery period is generally 1–3 business days from the date of order confirmation; this may vary depending on stock and shipping conditions.
5. Right of Withdrawal
The BUYER has the right to withdraw from the contract within 14 (fourteen) days from the date of receipt of the product, without providing any reason and without paying any penalty. To exercise this right, the BUYER must provide written notice to the SELLER within this period. To be eligible for return under the right of withdrawal, the product must be in its unopened, unused, and resalable condition.
6. Exceptions to the Right of Withdrawal
Products that cannot be returned due to their nature—such as single-use products, products that are not suitable for return for health or hygiene reasons once the packaging is opened, and perishable food products or those that may expire—are excluded from the right of withdrawal.
7. Resolution of Disputes
In the event of any disputes arising from this contract, the Consumer Arbitration Boards and Consumer Courts in the BUYER’s place of residence shall have jurisdiction, in accordance with the values announced by the Ministry of Trade.
